How we defend cases in Bayonne Municipal Court

What a Bayonne charge actually means

Bayonne is the southern tip of Hudson County: one municipal court, one police department in the same building, and the Route 440 and Broadway corridors where most traffic stops, DWI arrests and possession charges originate. The Bayonne Municipal Court handles those cases itself. If the charge is indictable, the file leaves Bayonne and is prosecuted by the Hudson County Prosecutor’s Office in Jersey City.

That split matters for you. A municipal-court case can often be resolved with a conditional discharge, a downgrade, or a dismissal on a bad stop; a Superior Court case needs a full defense built before the grand jury acts. We tell you which track you are on in the first call.

How a Bayonne criminal case moves

  1. Summons or arrest Bayonne police issue a complaint-summons for most disorderly persons and traffic matters; a complaint-warrant means a first appearance and possible detention hearing.
  2. First appearance In municipal court at 630 Avenue C, or at the Hudson County jail/Superior Court for indictable charges. This is when you should already have counsel.
  3. Discovery and motions We obtain the police report, body-cam and dash-cam footage, Alcotest records, and lab results, and move to suppress anything obtained through a bad stop or search.
  4. Resolution Dismissal, conditional discharge, a downgrade to an ordinance violation, PTI in Superior Court, or trial. Municipal convictions can be appealed to Superior Court within 20 days.

Why a lawyer who knows Bayonne matters

The court prosecutor, the judges, and the way Bayonne handles conditional discharges and plea downgrades are specific to this courtroom. We know which charges the prosecutor will realistically amend, what documentation the court expects before it grants a diversion, and how to challenge Alcotest calibration and Route 440 stop justifications, which come up constantly here.

Ihab Ibrahim has practiced criminal defense in Hudson County for more than a decade from the firm’s Jersey City office, and personally handles every Bayonne matter.

What Bayonne clients say

Rated 5 out of 5
No words can show my gratitude to Mr. Ibrahim and his great team. He represented me on a domestic violence case as my ex-wife alleged that I punched her. He believed that I was innocent and succeeded to dismiss the FRO.

Bayonne criminal defense questions

Yes, unless we appear on your behalf or the court permits a virtual appearance. Bayonne Municipal Court hears any offense committed inside the city regardless of where you live.

DWI in New Jersey is a motor-vehicle offense, not a crime, so it never appears on a criminal record. It does stay on your driving record permanently, which is why we fight the stop and the breath test rather than plead.

It is a first-offender diversion for certain disorderly persons drug charges: complete a supervision period and the charge is dismissed. Bayonne Municipal Court grants them regularly for eligible defendants; we prepare the application before your first appearance.

Municipal-court matters are usually a flat fee quoted at the consultation. Superior Court cases are quoted after we review the complaint. The consultation itself is free.
