What a domestic violence case in Bayonne actually means

Domestic violence is not its own crime in New Jersey. Under the Prevention of Domestic Violence Act, N.J.S.A. 2C:25-17, it is any of nineteen predicate offenses (simple assault, harassment, terroristic threats, criminal mischief, stalking and others) committed against a spouse, former spouse, household member, co-parent or dating partner. When Bayonne police respond to a call and see any sign of injury, arrest is mandatory, and the officer or the complainant can obtain a temporary restraining order the same night.

From that moment there are two tracks. The criminal charge goes to Bayonne Municipal Court if it is a disorderly persons offense, or to Hudson County Superior Court if indictable. The restraining order goes to the Family Part in Jersey City, where a final restraining order hearing is scheduled within roughly ten days. A final restraining order in New Jersey has no expiration date, bars firearm ownership for life, and puts your name in the state domestic violence registry. That hearing is usually the more consequential of the two.

How a Bayonne domestic violence case moves

  1. Arrest and TRO Bayonne police make the arrest, seize any firearms, and the complainant obtains a temporary restraining order from the municipal judge or Family Part. You are barred from the home and from contact, immediately.
  2. FRO hearing (about 10 days) In the Family Part at 595 Newark Ave. The judge decides whether a predicate act occurred, whether there is a history of abuse, and whether an order is needed to protect the complainant. This is a trial: witnesses, cross-examination, exhibits. Never attend it unrepresented.
  3. Criminal case The simple assault or harassment charge proceeds in Bayonne Municipal Court on its own schedule. Anything said at the FRO hearing can be used in the criminal case, so the two must be defended as one strategy.
  4. Resolution Dismissal of the TRO at hearing, a mutual civil restraints agreement in place of an FRO, dismissal or downgrade of the criminal charge, and a hearing for the return of seized weapons.

Source: N.J.S.A. 2C:25-17 et seq. (Prevention of Domestic Violence Act), 2C:29-9, 2C:12-1, 2C:33-4. The FRO hearing is civil, decided on a preponderance of the evidence, not beyond a reasonable doubt.

Why the FRO hearing is the case

Most people treat the criminal charge as the serious part and the restraining order as paperwork. It is the reverse. The criminal charge is often a disorderly persons offense with a realistic path to dismissal; the final restraining order is permanent, decided within days, under a lower standard of proof, in a courtroom where the complainant’s account is the prosecution’s case. We have had FROs dismissed at hearing by showing the alleged act did not happen as described and that there was no history that would justify an order.

Because Bayonne cases split between the municipal court and the Family Part in Jersey City, coordination matters: what you say in one room is evidence in the other. One lawyer, one strategy, both courts.

What Bayonne clients say

Rated 5 out of 5
No words can show my gratitude to Mr. Ibrahim and his great team. He represented me on a domestic violence case as my ex-wife alleged that I punched her. He believed that I was innocent and succeeded to dismiss the FRO.

Bayonne domestic violence questions

The complainant can ask the Family Part to dismiss the restraining order, and the judge usually grants that after confirming it is voluntary. The criminal charge belongs to the State, not the complainant; the Bayonne prosecutor decides whether it proceeds, though a reluctant witness often leads to dismissal.

Indefinitely. New Jersey FROs have no expiration date. They can only be dissolved by a later motion showing good cause and a change in circumstances.

Firearms seized under a TRO are held pending the outcome. If the TRO is dismissed and no FRO is entered, we file for their return; the prosecutor has 45 days to object and seek forfeiture. An FRO means a permanent bar.

A TRO that is dismissed does not create a criminal record and is not entered in the DV registry. An FRO is entered in the New Jersey domestic violence central registry and appears in law-enforcement and certain employment checks.
