New Jersey treats DWI under N.J.S.A. 39:4-50 as a motor-vehicle offense, not a crime. It never appears on a criminal record and cannot be expunged, because it is on your driving abstract instead, permanently. New Jersey has no look-back period: a conviction from twenty years ago still makes today’s charge a second offense. Since December 2019 most first offenses carry an ignition interlock requirement instead of a long suspension, but second and third offenses still bring one- to two-year and eight-year license losses and mandatory jail.
In Bayonne, the case is decided by the municipal judge at a bench trial. New Jersey court rules bar plea bargaining a DWI down to a lesser offense, so the realistic outcomes are dismissal, acquittal at trial, or a conviction on a lower BAC tier. That makes the technical defense everything: was the stop on Route 440 lawful, were the field sobriety tests administered to standard, was the Alcotest operator certified, was the twenty-minute observation period actually observed, and are the instrument’s calibration and solution-change records in order.

A New Jersey DWI conviction on a breath reading requires the State to lay a specific foundation: a certified operator, a 20-minute uninterrupted observation period with no burping or regurgitation, an instrument within its calibration window, and control-solution change records. Bayonne, like every municipal court, sees cases where one of those pieces is missing or contradicted by the video. When it is, the reading comes out and the State is left with an officer’s opinion.
Field sobriety tests are attacked the same way. The walk-and-turn and one-leg stand have to be administered on a level, well-lit surface exactly to the NHTSA protocol; a Route 440 shoulder at 1 a.m. rarely qualifies, and the video usually shows it.
For a first offense under 0.15% BAC, the suspension lasts only until an ignition interlock is installed, then you drive with the interlock for 3 to 12 months depending on the reading. At 0.15% or higher, a 4–6 month suspension applies with interlock during and after.
No. DWI is a motor-vehicle offense heard in municipal court. It does not create a criminal record, but it stays on your driving record permanently and counts as a prior offense for life.
Refusal is a separate offense with its own interlock period and fines, and it can be charged alongside DWI. If you were charged with refusal, the State must prove you were properly read the standard statement and clearly refused; that is a frequent defense.
No. Expungement applies to criminal records, and DWI is a traffic offense recorded on your MVC abstract. The only way to keep it off your record is to win the case.
