Questions About Your Legal Case?

Straight answers to the questions
we hear most.

Assert your right to silence. Politely yet firmly state your desire to consult with a lawyer, and refrain from giving any statements beyond basic identification until counsel is present. Securing legal representation early can profoundly influence your case’s outcome — your lawyer will protect your rights and immediately start building your defense.

Look for extensive experience with the type of charges you’re facing, a track record of success in similar cases, and deep familiarity with New Jersey’s courts and procedures. Communication matters too — choose an attorney who is responsive and explains complex legal concepts in understandable terms.

A divorce begins by filing a Complaint for Divorce with the Superior Court in the county where either spouse resides. New Jersey allows both fault-based and no-fault divorce — the latter requiring irreconcilable differences for at least six months. The process involves discovery, settlement negotiation, and trial if necessary, with mediation encouraged as a faster, more amicable alternative.

Custody decisions are based on the best interests of the child. Courts weigh factors including the parents’ ability to communicate and cooperate, the child’s needs, the stability of each home, any history of domestic violence, and the child’s preference if they are of sufficient age and maturity.

Probate involves validating the will, appointing an executor, inventorying assets, settling debts and taxes, and distributing property under court supervision. It can be time-consuming and costly — but proper estate planning, such as establishing a Trust, can avoid or minimize it, since Trust assets aren’t subject to probate.

A complete plan generally includes a Will directing the distribution of your assets, a Power of Attorney for financial decisions if you become incapacitated, an Advance Health Care Directive (Living Will) for medical wishes, and — where appropriate — a Trust to manage assets and potentially avoid probate.

By reviewing the disputed contract to identify breaches and each party’s rights, then strategizing the best path — negotiation, mediation, arbitration, or litigation — to resolve the dispute favorably while protecting the business’s interests and preserving professional relationships.

Choosing the right structure (LLC, corporation, partnership, or sole proprietorship) is fundamental, since it affects taxation and liability. You’ll also need required licenses and permits, compliance with employment laws if hiring, proper tax registration, intellectual property protection, and clear contracts for services and partnerships.
