Stopped for Suspected DWI in New Jersey? Do This.
Being pulled over on suspicion of DWI in New Jersey is a stressful situation. What you do in the next few minutes can significantly affect the outcome of your case. Here’s exactly what our New Jersey DWI attorneys at Ibrahim & Ibrahim Law Firm advise every client to do.
Step 1: Pull Over Safely and Calmly
As soon as you see the lights, signal and pull over to the right side of the road as soon as it is safe to do so. Turn off your engine, turn on interior lights if it’s dark, and keep your hands on the steering wheel where the officer can see them. Erratic behavior during the stop — swerving, failing to stop promptly — becomes part of the officer’s report.
Step 2: Be Polite — But Say As Little As Possible
You are required to provide your driver’s license, registration, and insurance. Beyond that, you have the right to remain silent. You do not have to answer questions like “Have you been drinking tonight?” or “Where are you coming from?” Politely say: “I prefer not to answer questions without my attorney present.” This is your constitutional right.
Step 3: Decline Field Sobriety Tests
Field sobriety tests (walk-and-turn, one-leg-stand, HGN) are voluntary in New Jersey. Politely decline. These tests are subjective, easy to fail even when sober, and are primarily used to build evidence against you. There is no legal penalty for refusing them.
Step 4: Understand Your Breathalyzer Obligations
Unlike field sobriety tests, breathalyzer tests are mandatory under New Jersey’s implied consent law. Refusing a breathalyzer triggers automatic penalties — including extended IID requirements and fines — regardless of whether you are convicted of DWI. Step 5: Do Not Consent to a Vehicle Search
Unless the officer has a warrant or probable cause, you are not required to consent to a vehicle search. Politely say: “I do not consent to a search.” The officer may search anyway if they claim probable cause — but your refusal is legally documented and can be challenged later.
Step 6: Remember Everything
As soon as you can, write down everything you remember: the time, location, reason the officer gave for the stop, what was said, how the tests were conducted, and any witnesses. This information is invaluable to your criminal defense attorney.
Step 7: Call an Attorney Immediately
Whether you are released or arrested, call a DWI lawyer as soon as possible. Evidence preservation, early investigation, and prompt legal counsel are all critical in the first hours and days after a DWI stop.
