Expungement in New Jersey is governed by N.J.S.A. 2C:52-1 et seq. Dismissals, acquittals and completed diversion programs can be expunged immediately. One indictable conviction (plus disorderly persons offenses) can be expunged five years after completing the sentence, or sooner under the early-pathway rule. Clean-slate expungement clears an entire record ten years after the last conviction. Petitions for Jersey City cases are filed at the Hudson County Superior Court.
The 2019 reforms transformed New Jersey expungement. 2C:52-2 now allows expungement of one indictable conviction along with any number of disorderly persons offenses five years after completing the sentence — including payment of fines, which can now be satisfied through a payment plan rather than in full. The early-pathway rule permits a petition at four years where the court finds it in the public interest. A record consisting only of disorderly persons offenses can be expunged after five years, for up to five offenses. Marijuana convictions from before legalization received their own automatic relief.
Clean-slate expungement is the broadest tool: ten years after the last conviction, fine payment and release from supervision, a petitioner with no intervening offenses can have the entire record expunged, including multiple indictable convictions, with limited exceptions. Some offenses can never be expunged — murder, kidnapping, aggravated sexual assault, arson, robbery in certain circumstances, perjury, and offenses by public officials involving their office. Dismissals, acquittals and cases that ended in diversion are cleared quickly and are the most commonly missed opportunity: many people carry an arrest record for a charge that was dropped years ago.

Every week we meet people who lost a job or an apartment over a charge that was dismissed a decade ago, or a single disorderly persons conviction from their twenties. The 2019 reforms made both routinely clearable, but nothing happens automatically outside the marijuana context — someone has to file. The petition requires exact docket numbers and dispositions from every court involved, and a Jersey City record often spans the municipal court, the Superior Court and an old case in another county. Getting one detail wrong means the petition is returned.
Timing also matters more than people expect. For non-citizens, an expungement does not erase the record for immigration purposes, and disclosure obligations differ; for professional licensing, the rules vary by board. We review those consequences before filing, so an expungement helps where it is supposed to and does not create a problem elsewhere.
Five years after completing the sentence for one indictable conviction (or four years where the court finds it in the interest of justice), five years for disorderly persons convictions, six months after completing PTI or conditional discharge, and immediately for a dismissal or acquittal. Clean-slate relief clears an entire record ten years after the last conviction.
Yes, immediately, and it is the most overlooked expungement. A dismissed charge still leaves an arrest record visible on many background checks until a court orders it expunged.
Murder, kidnapping, aggravated sexual assault, arson in certain circumstances, robbery in some cases, perjury, and offenses committed by public officials involving their office, among others listed in 2C:52-2. Motor-vehicle offenses including DWI are not expungeable because they are not criminal records.
Usually not. Most Hudson County expungement petitions are decided on the papers without a hearing when they are properly prepared and unopposed. A hearing is scheduled only if an agency objects.
Not for federal immigration purposes — an expunged conviction generally still counts. That does not mean it is not worth doing for employment and housing, but the immigration analysis should be done separately before filing.
