The charge is indictable, it is prosecuted by the Hudson County Prosecutor’s Office at the Brennan Courthouse, and second-degree aggravated assault carries a presumption of incarceration and the No Early Release Act. Quick answer

Aggravated assault in Jersey City is charged under N.J.S.A. 2C:12-1(b) and prosecuted at Hudson County Superior Court, 583 Newark Avenue. It is graded fourth degree (18 months), third degree (3–5 years) or second degree (5–10 years, 85% served under NERA) depending on the injury, whether a weapon was involved, and whether the victim was a police officer or other protected person. Downgrading to simple assault eliminates state-prison exposure.

What makes an assault 'aggravated' in New Jersey

2C:12-1(b) lists more than a dozen ways an assault becomes aggravated. The ones Jersey City prosecutors use most: causing serious bodily injury, or attempting to (second degree); causing significant bodily injury (third degree); causing bodily injury with a deadly weapon (third degree, or fourth if the injury was only negligent); pointing a firearm at someone (fourth degree); and causing bodily injury to a police officer, firefighter, EMT, school employee, bus driver or other protected person while they are on duty (third degree, or second degree with significant injury).

The definitions matter. ‘Serious bodily injury’ means a substantial risk of death, serious permanent disfigurement, or protracted loss of a bodily function. ‘Significant bodily injury’ means a temporary loss of a bodily function or of one of the five senses. A black eye or a cut requiring stitches is bodily injury — simple assault — unless the State can prove more. Emergency-room records, not the police report’s description, decide this question, and we get those records first.

How a Jersey City aggravated assault case moves

  1. Arrest and detention hearing Aggravated assault is charged on a warrant. You are taken to the Hudson County jail in Kearny for a first appearance within 48 hours. On second-degree charges the prosecutor frequently moves for detention; the hearing within days is our first fight, and we come with the video and medical records if they exist.
  2. Pre-indictment negotiation The Hudson County Prosecutor’s Office screens every case before presenting it to the grand jury. This window is where downgrades happen: we present the medical evidence, the video and the self-defense facts to the screening assistant prosecutor.
  3. Indictment, discovery and motions If indicted, full discovery follows: body-cam, surveillance, witness statements, medical records. We retain a medical expert where injury grading is disputed and file suppression motions on any statement or identification.
  4. Resolution Dismissal, downgrade to simple assault and remand to municipal court, PTI on a third- or fourth-degree charge, a negotiated plea below the presumptive range, or jury trial on self-defense.

How aggravated assault cases are actually resolved in Hudson County

The Hudson County Prosecutor’s Office charges aggravated assault aggressively at arrest — an officer’s report of ‘serious injury’ is enough for a second-degree complaint — and then screens the case before indictment. That screening, not the trial, is where most Jersey City aggravated assault cases are decided. A prepared defense at that stage, with hospital records showing the injury was a fracture that healed in weeks rather than a permanent loss, with surveillance video from the bar or the PATH plaza, and with the complainant’s own prior conduct, regularly produces a third-degree or simple-assault downgrade.

When a case must be tried, Hudson County juries hear self-defense claims fairly, and the State bears the burden of disproving them. We prepare every case as a trial from the first day, because that preparation is what makes the prosecutor negotiate.

Jersey City aggravated assault questions

Fourth degree carries up to 18 months, third degree 3–5 years, and second degree 5–10 years. Second-degree aggravated assault falls under the No Early Release Act, so 85% of the sentence must be served before parole eligibility.

Yes, and it is the most common favorable outcome. If the medical evidence does not establish serious or significant bodily injury, or no deadly weapon was involved, the charge can be downgraded to simple assault, which returns the case to Jersey City Municipal Court with a six-month maximum and no state prison.

Pretrial Intervention is available for third- and fourth-degree charges, though the prosecutor may object where violence is involved. Second-degree charges carry a presumption against PTI that can only be overcome with compelling reasons. We prepare the application to meet that standard.

Not necessarily. New Jersey has no cash bail. If the prosecutor files a detention motion, a hearing is held within days and the State must show by clear and convincing evidence that no release conditions would protect the public. Many aggravated assault defendants are released with conditions; the hearing must be contested.
