NJSA 2C:52-1 — New Jersey Expungement Lawyer

N.J.S.A. 2C:52-1 is the foundation of New Jersey’s expungement law — providing a legal mechanism for eligible individuals to have their arrest records, criminal charges, and convictions extracted and isolated from public access. A successful expungement allows a person to legally answer “no” to questions about prior arrests or convictions on most employment applications, housing applications, and professional license applications — providing the genuine second chance New Jersey’s expungement law was specifically designed to give people who have satisfied their obligations and moved forward with their lives.

Ibrahim & Ibrahim Law Firm handles expungement petitions throughout Hudson County and across New Jersey. Our attorneys evaluate eligibility, prepare complete petitions, manage all required agency notifications, respond to any objections, and appear at expungement hearings to secure the final court order that clears our clients’ records.

Why Choose Ibrahim & Ibrahim for Your New Jersey Expungement?

  • Complete petition preparation: We handle every step of the expungement process — eligibility evaluation, petition drafting, agency notification, objection response, and court appearance — so our clients do not have to navigate the complex procedural requirements of N.J. Court Rule 3:28A alone.
  • Multiple conviction expungements: New Jersey’s Clean Slate law allows expungement of an entire prior criminal record after 10 years in a single petition. We evaluate the full scope of every client’s record and pursue the broadest possible expungement in every case.
  • Early pathway expertise: Certain clients qualify for expungement on an accelerated timeline under the public interest standard. We evaluate every client for this early expungement pathway at the first consultation.
  • Expungement hearing advocacy: When prosecutors or state agencies object to a petition, we appear and argue for our client at the expungement hearing — presenting the statutory factors that support granting relief over any objection raised by the State.

Understanding N.J.S.A. 2C:52-1 — How New Jersey Expungement Works

N.J.S.A. 2C:52-1 defines expungement as the extraction, sealing, impounding, and isolation of all records on file within any court, detention or correctional facility, law enforcement or criminal justice agency concerning a person’s detection, apprehension, arrest, detention, trial, or disposition of an offense. Upon grant of expungement, all covered records are removed from public access and the person may legally deny their existence in most circumstances.

Indictable Crime Expungement — Standard Pathway: One indictable conviction is expungeable after a 6-year waiting period from conviction, fine payment, completion of probation, or release from incarceration — whichever is latest. A person with more than three indictable convictions is generally not eligible for expungement of those records.

Disorderly Persons Expungement: Disorderly persons and petty disorderly persons convictions are expungeable after a 5-year waiting period. More than five such convictions generally renders a person ineligible for expungement of those records.

Clean Slate Expungement — N.J.S.A. 2C:52-5.3: Under New Jersey’s 2019 Clean Slate law, a person who has not been convicted of any crime or offense for 10 or more years may petition for expungement of their entire prior criminal record — including multiple convictions that would not be individually expungeable under the standard pathway.

How We Handle Your New Jersey Expungement Petition

  • Complete criminal history review: We obtain your complete New Jersey criminal history from NJSP before filing to ensure our petition accurately addresses every arrest, charge, and conviction — preventing objections based on incomplete or inaccurate disclosure that can delay or defeat the expungement.
  • Petition drafting and filing: We prepare the formal expungement petition, proposed order, and all required exhibits in compliance with N.J. Court Rule 3:28A, filing in the Superior Court of the county of conviction and managing the entire filing and service process.
  • Agency notification management: New Jersey expungement petitions must be served on multiple agencies — the prosecutor, State Police, Attorney General, and the municipal court and law enforcement agency of every relevant arrest. We manage this complete notification process so not a single required agency is missed.
  • Objection response: When a prosecutor or state agency objects to an expungement petition, we prepare comprehensive written responses and appear at the expungement hearing to argue why relief should be granted despite the objection — presenting the statutory public interest factors that support the petition.

N.J.S.A. 2C:52-1 Expungement Waiting Periods and Eligibility

Your Rights Under N.J.S.A. 2C:52-1 New Jersey Expungement Law

  • Right to petition for expungement: Any person who meets the eligibility requirements under N.J.S.A. 2C:52-1 has the legal right to petition the Superior Court for expungement of their criminal record — regardless of the severity of the original offense, within the statutory framework of eligible offenses and waiting periods.
  • Right to a hearing: You have the right to a court hearing on your expungement petition where any objections from prosecutors or state agencies are formally addressed and the court determines whether the statutory requirements for relief are satisfied.
  • Right to deny the record after expungement: Upon entry of an expungement order, you may legally deny the existence of the expunged arrest and conviction on most employment, housing, and license applications — with limited exceptions for law enforcement, judicial, and specific professional or government positions that ask about expunged records.
  • Right to a Clean Slate after 10 years: Under New Jersey’s 2019 Clean Slate law, any person crime-free for 10 or more years has the right to petition for expungement of their entire prior criminal history in a single petition — regardless of the number of prior convictions.

The New Jersey Expungement Petition Process — Step by Step

Step 1 — Eligibility Evaluation: We obtain your complete New Jersey criminal history from the State Police and evaluate eligibility for every arrest, charge, and conviction in your record — determining which pathway applies (standard, Clean Slate, or early), the exact date eligibility was reached, and whether any ineligible offenses affect the overall petition.

Step 2 — Petition Preparation and Filing: We prepare the formal petition, proposed expungement order, and all required exhibits under N.J. Court Rule 3:28A. The petition is filed in the Superior Court Law Division in the county of the most recent conviction and assigned a docket number.

Step 3 — Service on Required Agencies: New Jersey law requires service of the expungement petition on numerous agencies. We manage this complete service process — filing proof of service with the court and tracking every required response period.

Step 4 — Objection Period and Hearing: After service, a 35-day objection period runs. If no objections are filed, the court typically grants the expungement without a hearing. If objections are filed, we appear and argue at the expungement hearing for our client — presenting the statutory factors that support granting relief despite any opposition from the State.

No words can show my gratitude to Mr. Ibrahim and his great team. He represented me on a domestic violence case as my ex-wife alleged that I punched her. He believed that I was innocent and succeeded to dismiss the FRO. I highly recommend anyone that has a case related to domestic violence to hire him.
