Jersey City traffic offenses attorney

Jersey City writes more traffic summonses than any court in Hudson County: the Holland Tunnel approaches, Route 440, Kennedy Boulevard, Route 1&9 and the Turnpike Extension all feed 365 Summit Avenue. Most people pay online and never learn what the points cost them. Twelve points is a suspension; six in three years is a surcharge; two moving violations can raise insurance for years.

Traffic offenses in Jersey City are heard at Jersey City Municipal Court, 365 Summit Avenue. Moving violations carry MVC points under N.J.S.A. 39:4 — 2 points for careless driving, 2 to 5 for speeding, 5 for reckless driving — plus a $150 surcharge at six points within three years and a suspension at twelve. Many tickets can be amended to a no-point offense such as unsafe driving (39:4-97.2) with counsel.

Why a Jersey City traffic ticket is not just a fine

New Jersey’s point system attaches to your license, not the ticket. Each moving violation adds points under the MVC schedule: 2 for most speeding and careless driving, 4 for 15–29 mph over, 5 for reckless driving or 30+ over. Reach six points within three years and the MVC bills an annual surcharge of $150 plus $25 per additional point; reach twelve and your license is suspended. Points also drive insurance: carriers surcharge two or more moving violations for three years, which usually costs more than the fine.

Paying the ticket on NJMCdirect is a guilty plea with full points. Appearing — or having counsel appear — opens the alternatives: an amendment to unsafe driving under 39:4-97.2, which carries no points and can be used twice in five years; a downgrade from a 4-point to a 2-point offense; or a dismissal when the officer does not appear or the radar or pacing evidence fails. Jersey City’s municipal prosecutors handle these amendments routinely, but only when they are asked correctly and the driving abstract supports it.

How a Jersey City traffic case moves

  1. The summons If the ticket is marked ‘court appearance required’ you must appear or be represented. If not, paying online is a guilty plea. Either way, do not pay before you know the points.
  2. Letter of representation We file with the court by email, request discovery (radar calibration, officer’s notes, dash-cam), and in most cases you never need to appear.
  3. Negotiation We meet the municipal prosecutor with your driving abstract and propose the amendment: unsafe driving, a lower-point section, or dismissal of companion tickets.
  4. Resolution Amendment and fine, dismissal, or trial when the evidence fails. Convictions may be appealed to Superior Court within 20 days.

Where Jersey City tickets come from, and what that means for the defense

Jersey City’s traffic enforcement clusters on a few corridors: Route 440 and Communipaw Avenue (speed), Kennedy Boulevard and Route 1&9 (speed, cell phone, careless driving), the Holland Tunnel approaches and Route 139 (lane violations, tunnel-bound stops by Port Authority police), and the Turnpike Extension (State Police speed). Each source has its own evidence profile — radar versus pacing versus a Port Authority officer’s observation — and its own appearance rate. Officers who do not appear produce dismissals; radar units without calibration records produce suppression.

We appear at 365 Summit Avenue every week and know the prosecutors’ practice on unsafe-driving amendments and point downgrades. For most clients that means a no-point resolution without a court appearance.

What Jersey City clients say

Rated 5 out of 5
No words can show my gratitude to Mr. Ibrahim and his great team. He represented me on a domestic violence case as my ex-wife alleged that I punched her. He believed that I was innocent and succeeded to dismiss the FRO.

Jersey City traffic ticket questions

Paying is a guilty plea with full points and the resulting insurance surcharge. For any moving violation carrying points, it is usually cheaper to contest it and seek a no-point amendment. Parking tickets and equipment violations can generally be paid.

Twelve points triggers a suspension. Six or more points within three years triggers a $150 annual surcharge plus $25 for each point over six. Points drop by three for each year without a violation and by up to three for a defensive driving course.

N.J.S.A. 39:4-97.2, a no-point violation used to resolve careless driving and speeding tickets. It carries a fine and a $250 MVC surcharge, and can be used twice in five years; a third within five years carries four points.

Only if the summons says ‘court appearance required’ or you want to contest it. In most cases we can appear on your behalf, and Jersey City Municipal Court accepts letters of representation by email.
