Driving while suspended in Jersey City is charged under N.J.S.A. 39:3-40 at Jersey City Municipal Court. A first offense carries a $500 fine and up to six additional months of suspension; a third offense adds 10 days in jail. If the underlying suspension was for DWI or refusal, jail of 10 to 90 days is mandatory, and driving while suspended for a second or subsequent DWI is a fourth-degree crime under 2C:40-26 with a mandatory 180-day sentence.
New Jersey suspends licenses for many reasons besides DWI: twelve or more points, unpaid MVC surcharges, unpaid parking tickets or court fines, failure to appear on a summons, lapsed insurance, and child-support arrears. The MVC mails a notice; if you moved and did not update your address, the notice goes nowhere and the first you hear of it is a Jersey City police officer at your window. 39:3-40 then escalates: $500 and up to six months added for a first offense, $750 and one to five days in jail for a second, $1,000 and ten days for a third, plus a $250 annual surcharge for three years.
Two enhancements matter most. If the suspension arose from a DWI or refusal, 39:3-40(f) requires 10 to 90 days in jail and an additional one-to-two-year suspension, even on a first offense. And 2C:40-26 makes driving during a suspension for a second or later DWI a fourth-degree crime with a mandatory 180-day term that no judge can reduce. Those cases leave municipal court for the Superior Court. The central defense in most 39:3-40 cases is knowledge: the State must show the MVC gave proper notice of the suspension, and it often cannot.

The MVC suspends by mail, and Jersey City has one of the most mobile populations in the state. Suspensions for a missed court date on an old parking ticket or an unpaid surcharge go to the last address on file, and a large share of the drivers charged at 365 Summit Avenue had no idea. Under State v. Sandoval, the State must prove you knew or should have known of the suspension; when the MVC’s certification shows notice went to an address you had already left, the charge is dismissed. We obtain that certification in every case.
For DWI-related suspensions, where jail is mandatory on conviction, the defense shifts to the underlying suspension order and the timing of the stop. And for 2C:40-26 charges, where 180 days cannot be reduced, we examine whether the prior DWIs were validly counted and whether the suspension period had in fact expired.
Yes, in most cases. The State must prove the MVC sent proper notice of the suspension to your address of record. If notice went to an old address or was never sent, the driving-while-suspended charge fails. We obtain the MVC certification to check.
Usually it is a traffic offense under 39:3-40 heard in municipal court. It becomes a fourth-degree crime under 2C:40-26, heard in Superior Court, when the suspension was for a second or subsequent DWI or refusal — with a mandatory 180-day jail term.
It depends on the reason: pay outstanding surcharges or fines, resolve the missed court date, complete the suspension period, or satisfy the DWI requirements (IDRC, interlock). Then pay the $100 restoration fee. We map the steps and clear them before your court date where possible.
Not on a first or second offense in most cases. A third offense carries 10 days, and any suspension arising from a DWI carries 10–90 days mandatory. Those cases require a knowledge or timing defense to avoid jail.
