Drug DUI in New Jersey: Everything You Need to Know
Most people think of drunk driving when they hear “DUI” or “DWI,” but New Jersey law also prohibits driving under the influence of drugs — including marijuana, prescription medications, and illegal substances. If you’ve been charged with a drug DUI in NJ, our criminal defense attorneys at Ibrahim & Ibrahim Law Firm are here to help.
How Does NJ Law Define Drug DUI?
Under N.J.S.A. 39:4-50, it is illegal to operate a motor vehicle while under the influence of any narcotic, hallucinogenic, or habit-producing drug, or any chemical inhalant. Importantly, there is no per se BAC equivalent for drugs in NJ — unlike alcohol, there is no single “legal limit” for drug concentration. The standard is whether the driver was impaired.
What Is a Drug Recognition Expert (DRE)?
When police suspect drug impairment, they may call in a Drug Recognition Expert (DRE) — an officer specially trained to identify drug impairment through a 12-step evaluation process. This evaluation includes:
- Breath alcohol test
- Interview of the arresting officer
- Preliminary examination
- Eye examinations
- Divided attention tests
- Vital signs (pulse, blood pressure, temperature)
- Dark room examinations
- Muscle tone assessment
- Injection sites check
- Subject interview
- Opinion and toxicology
DRE evaluations are highly subjective and can be successfully challenged by an experienced DWI lawyer in NJ.
Marijuana DUI in New Jersey
Even though recreational marijuana is legal in New Jersey, driving while impaired by marijuana is still illegal. However, the science of marijuana impairment testing is far less developed than alcohol testing. There is no reliable roadside breathalyzer for marijuana, and blood tests can detect THC long after impairment has ended — making these cases highly defensible.
Prescription Drug DUI
You can be charged with a drug DUI even if you are taking legally prescribed medication. If a prescription drug impairs your ability to drive safely, you can face the same penalties as an alcohol DWI. Learn about all the DWI penalties in New Jersey that apply regardless of substance.
Defenses Against a Drug DUI in NJ
- Challenging the DRE evaluation methodology and the officer’s qualifications
- Attacking the blood test chain of custody and lab procedures
- Arguing that the substance detected was not causing impairment at the time of driving
- Challenging the initial traffic stop
